Jakarta, March 6, 2023. Since the issuance of government regulation no. 23 of 2021 concerning forestry management which is an order from article 108 and article 112 paragraph 2 concerning Forest Areas with Special Management \/ KHDPK. This KHDPK policy is here to answer the interests of 1. Social Forestry 2. Forest Area Arrangement in the context of Forest Area Confirmation 3. Use of Forest Areas 4. Forest Rehabilitation 5. Forest Protection and 6. Utilization of environmental services with a total area of 1,103,841 hectares which will be handled directly by the government. Before the regulation on Forest Areas with Special Management, all protected and production function forest areas in Central Java Province, East Java Province, West Java Province, and Banten Province were managed by Perum Perhutani.<\/p>\n

Exactly 2 years and 26 days since PP No. 23 of 2021 was promulgated on February 2, 2021, derivative regulations to implement one of these interests in the form of Regulation of the Minister of Environment and Forestry No. 4 of 2023 concerning Management of Social Forestry in Forest Areas with Special Management \/ KHDPK were issued and promulgated on February 28, 2023 so that the ministerial regulation confirms the status of the legal relationship of management and access to forest areas, especially for social forestry in Part of the State Forests Located in Forest Areas in Central Java Province, East Java Province, West Java Province, and Banten Province.<\/span>
<\/p>\n

Roni Usman, who is the General Chairperson of AP2SI, responded to the issuance of the LHK Regulation by saying, "Although it has taken a relatively long time, the issuance of social forestry regulations in the KHDPK should still be appreciated and it is hoped that it will provide great benefits, namely changing the pattern, structure and model of forestry management in Java, especially in the 4 existing provinces, and in addition, village communities, both those in or around the forest area, can have better status, access, and management of forest areas," he said.<\/span>
<\/p>\n

"However, after reading this ministerial regulation, we still consider that there are conditions that are less comfortable and worrying from the institutional and content side of this regulation because there is still involvement and role of Perhutani in the implementation of social forestry in KHPDK such as Government Assistants in KHDPK, management\/utilization of assets, and a large tendency to encourage institutionalization in the form of productive Perhutani forestry partnerships. So it is very important that the government must immediately carry out strong internalization of the objectives, values, and principles of this ministerial regulation in order to change the existing culture so that the implementation of fairer and more sustainable forest management can occur". He added.<\/span>

Meanwhile, Dedi, the chairman of AP2SI West Java who is also the administrator of LMDH Alamendah, said, "The regulation of the Minister of Environment and Forestry has been eagerly awaited by the community, especially farmers who manage social forestry who have received the IPHPS or KULINKK Decree. The community has not really felt the full presence of the state. Hopefully, with the presence of the LHK Regulation No. 4 of 2023, it can answer the temporary concerns in the community regarding the unclear information regarding the certainty of the sustainability of the Social Forestry that they have managed after the change in regulations. In addition, a very important note to the Ministry of Environment and Forestry, we actually hope that groups that already have permits and recognition or are in the proposal process will all be included in the KHDPK without reducing the area. In addition, within the framework of the KHDPK for interests outside of social forestry, it is hoped that forest areas that have changed function, such as in several places in West Java that have changed function to become settlements, even in which there are already public and social facilities, can be given legal status immediately."<\/span>

Slamet, the chairman of AP2SI East Java and also the chairman of KTH Alas, said "regarding the determination of the location of the area for social forestry in KHDPK based on the map attached to the Decree of the Minister of Environment and Forestry Number SK.287\/MENLHK\/SETJEN\/PLA.2\/4\/2022, which is predominantly located in a forest area with a protected function, this will certainly be a challenge for forest farmer groups to be able to utilize the land to be productive and sustainable because the area in this protected function is far from business roads and farmer settlements and has stricter utilization regulations than the Forest Area with a production function, it is very important that this area must return to the technical criteria of KHDPK by upholding the principle of participation."<\/span><\/p>
